Des grand-mères Mohawks agressées par des gardes de l'Agence des services frontaliers du Canada (ASFC)

Samedi le 14 juin 2008, vers 14h30 de l'après-midi, un véhicule transportant deux activistes écrivaines et grand-mères Kanion'ke:haka (Mohawk) fut stoppé à Akwesasne alors qu'il traversait la frontière étasunienne pour entrer au Canada. Akwesasne est une communauté autochtone Kanion'he:haka qui s'étend sur les soi-disant provinces d'Ontario, Québec et New-York; les membres de la communauté traversent régulièrement les frontières de ces "États" et "provinces".


Katenies vit à Akwesasne, non loin de sa mère, sa fille et ses trois petits-enfants; tous résident des deux cotés de la "frontière". Kahentinehta, grand-mère elle aussi, est de Kahnawake. Katenies et Kahentinehta publient le journal Mohawk Nation News (www.mohawknationnews.com) et ont également été déléguées au Sommet des Frontières des Peuples Autochtones à San Xavier (sur le territoire Tohono O'odham, en Arizona) en novembre 2007.

Katenies fut arrêtée par les gardes de l'Agence des services frontaliers du Canada (ASFC) en vertu d'un mandat d'arrestation invoquant les causes suivantes: dossier non résolu pour avoir prétendument franchit les frontières illégalement en 2003 et offense car elle avait alors refusé d'apparaître en cours et de valider le système judiciaire colonial. Katenies a maintenu, depuis 2003, que les frontières officielles et la cour coloniale du Canada n'ont aucun droit sur les gens de Kanion'he:haka ou sur leur terre.

Samedi dernier, Katenies a réitéré le fait qu'elle ne reconnaissait pas l'autorité de l'ASFC sur la terre de Kanion'ke:haka, ainsi qu'elle l'a toujours fait. Elle fut alors brutalement arrêtée par au moins quatre gardes mâles qui lui ont plaqué le visage contre terre, qui l'ont menottée puis mise en garde-à-vue, où on l'a détenue durant trois jours.

Quant à Kahentinehta, âgée 68 ans, les gardes de l'ASFC exigèrent qu'elle quitte la voiture qu'elle conduisait. Elle refusa, et elle aussi fut brutalement assaillie par quatre gardes mâles de l'ASFC et menottée fermement. C'est a ce moment qu'elle a eu une crise cardiaque. Grâce à l'intervention de son frère – un avocat du coin qui traversait alors les frontières et ce, juste au bon moment – elle fut finalement amenée à l'hôpital local de Cornwall, en Ontario, par ambulance; hôpital où elle a passé les trois derniers jours aux soins intensifs. Sa condition est stable et elle sera bientôt transférée dans un hôpital d'Ottawa afin de recevoir des traitements supplémentaires et une éventuelle chirurgie.

L'ASFC a, à l'origine, indiqué qu'elle allait accuser Kahentinehta de diverses infractions, mais ces charges ne furent jamais présentées , probablement pour dissimuler la manière brutale dont elle et Katenies furent arrêtées en premier lieu.

Pendant ce temps, Katenies fut emprisonnée après sa brutale arrestation. Elle n'est passé devant un juge (de la Cour supérieure de Cornwall) que lundi dernier, soit le 16 juin 2008.

Des défenseurs des Six Nations, de Sharbot Lake et Akwesasne assistèrent à l'audience pour appuyer l'attitude défiante de Katenies face au tribunal colonial canadien. Plusieurs aînés de la communauté d'Akwesasne firent référence au blocage des ponts entrepris entre 1960 et 1970 et qui revendiquait la liberté de circulation des peuples indigènes aux frontières. Ils considèrent l'attitude actuelle de Katenies comme faisant partie intégrante de la lutte en cours et à long terme pour la souveraineté autochtone.

À l'audience, l'avocat fédéral de la Couronne a refusé que Katenies soit libérée sous caution. Un vieil enquêteur de l'ASFC qui semble avoir lancé un règlement de compte contre Katenies depuis 2003, a validé les attestations la Couronne. Il souligna les différents mandats et comparutions au tribunal du dossier, ainsi que le refus continuel et persistant de Katenies de reconnaître l'autorité du système judiciaire colonial, ou la juridiction de l'ASFC sur les frontières.

Selon l'enquêteur de l'ASFC, Katenies « n'a que du mépris pour le système judiciaire canadien». L'enquêteur, qui a vécu et travaillé aux frontières de Cornwall pendant vingt ans, a été forcé d'admettre que «il n'est pas rare» pour les Mohawks de se plaindre directement aux officiers des frontières du manque de juridiction, bien qu'il qualifie Katenies de «cas extrême».

Katenies et sa mère, Nancy Davis, s'opposèrent au tribunal. Nancy Davis refusa de révéler au tribunal si elle habitait dans la partie de Akwesasne qui est en Ontario ou dans celle qui est au Québec, affirmant clairement qu'elle habitait sur le territoire Kanion'ke:haka et qu'elle était une citoyenne de la Confédération Haudenosaunee. Elle commenta en souriant: «je suis la seule qui puisse exercer de l'autorité sur ma fille ».

Pendant le contre-interrogatoire mené par l'avocat de la Couronne, Nancy Davis déclara: « Nous sentons que nous avons le droit de traverser là où nous voulons, d'aller où bon nous semble. [La frontière] est une ligne imaginaire pour les Américains et les Canadiens, pas pour les Mohawks.»

Lorsqu'on lui demanda si elle reconnaissait l'autorité du tribunal, Nancy Davis répondit simplement: «Non.»

Katenies s'adressa également au tribunal, réitérant depuis le début qu'elle ne reconnaissait pas ses juridictions, refusant ostensiblement d'accepter les accusations portées contre elle, déclinant jusqu'à la lecture des ses charges. Lorsque le greffier du tribunal essaya de lui faire prêter serment, Katenies déclara: « Je peux seulement dire ce que je sais.»

Katenies insista sur le fait qu'elle continuera d'exiger des tribunaux que la question de juridiction soit remise en question; c'est-à-dire sous quelle autorité les tribunaux canadiens coloniaux, les agences et les institutions peuvent-elles clamer avoir une juridiction sur la souveraineté Mohawk. Elle déclara avec force: «Je suis quelqu'un de passionnée, je suis mère et grand-mère. Mais je n'ai reçu aucun respect. Personne n'a prêté attention à ce que j'ai allégué.»

Katenies a déjà rendu à la Cour une motion de déboutement et a invoqué la question de la juridiction le 18 janvier 2007, soit il y a presque un an et demi. Sa motion complète est disponible au lien suivant:

Pendant le contre-interrogatoire, l'avocat de la Couronne demanda à Katenies si elle accepterait de payer une caution, ce à quoi elle répondit: « À ce stade de l'affaire ce serait une extorsion, la question de la juridiction n'a pas encore été traitée. » Elle ajouta: « Je ne vois pas pourquoi vous devriez m'incarcérer ni pourquoi vous insistez sur cette proposition sans avoir d'abord répondu à ma question.»

Elle rendit l'accusation de mépris à la Couronne en affirmant: « Ce sont [vos lois] et votre constitution dont vous ne cessez de parler. Pourquoi continuez-vous à nous ignorer, moi et mon peuple, nous qui avons notre terre et notre propre constitution? »

Dans sa proposition finale, la Couronne soutint que Katenies « n'avais que dédain pour les lois de ce tribunal.» Elle ajouta également ce point évident: « Tout à fait franchement, votre excellence, la mère et la fille ne reconnaissent pas notre juridiction.»

La Couronne demanda au tribunal de garder Katenies en détention, ajoutant: « Elle n'est pas intéressée à comparaître en cour et ne nous reconnaît pas.»

Néanmoins, la juge qui présidait l'audience, Mme Leblanc, décida de libérer Katenies sous certaines conditions élémentaires: que Katenies habite avec sa mère et avertisse la police de Akwesasne en cas de changement d'adresse (Katenies habite depuis huit ans chez sa mère, soit depuis la mort de son père); que sa mère dépose une caution de garantie (de 1000$ sans aucun dépôt); et que Katenies paraisse en cours ou assigne quelqu'un à sa défense. Sa prochaine date de comparution est fixée pour le 14 juillet 2008, à 9 heures du matin à la Cour supérieure de Cornwall.

Autant Kahentinehta que Katenies, malgré l'agression brutale par des officiels de l'ASFC portées sur elles, ont maintenu une attitude de défi et ont fait le vœu de continuer à contester la juridiction des tribunaux et des frontières officielles.

Report: Mohawk grandmothers attacked by Canadian Border Services Agency guards

This past Saturday, June 14, 2008, around 2:30pm, a vehicle with two outspoken Kanion’ke:haka (Mohawk) activists, writers and grandmothers was stopped at Akwesasne while crossing into "Canada" from the "USA". Akwesasne is a Kanion’ke:haka Indigenous community that includes parts of so-called Ontario, Quebec and New York, and community members routinely cross between "states" and "provinces”.

Katenies lives in Akwesasne, with her mother and near her daughter and three grandchildren, who reside on both sides of the "border". Kahentinehta, also a grandmother, is from Kahnawake. Katenies and Kahentinehta publish Mohawk Nation News and were delegates to the Indigenous Peoples Border Summit in San Xavier, Tohono O'odham Nation (Arizona) in November 2007.

Katenies was targeted for arrest by Canadian Border Services Agency (CBSA) guards on an outstanding warrant for allegedly "running the border" in 2003, and offenses resulting from her refusal to appear in court and validate the colonial justice system. Katenies has maintained since 2003 that border officials and the Canadian colonial courts have no jurisdiction over Kanion’ke:haka people or land.

This past Saturday, Katenies reiterated that she does not recognize the authority of the CBSA over Kanion’ke:haka land, as she has always done. She was then brutally arrested, with at least four male guards forcing her face down onto the ground, handcuffing her, and taking her into custody, where she remained for three days.

CBSA guards then demanded that Kahentinehta, 68, leave the car she was driving. She refused, and she too was brutally overpowered by at least four male CBSA guards and handcuffed tightly. Kahentinehta suffered a heart attack while handcuffed. However, due to the timely intervention of her brother – a local lawyer who was crossing the border at that time -- she was eventually taken to the local hospital in Cornwall, Ontario by ambulance, where she has spent the last three days in the Critical Care Unit. Her condition is stable and she will be transferred to a hospital in Ottawa for further treatment and possible surgery.

The CBSA had originally indicated that they would charge Kahentinehta with various offenses, but those charges were never brought forward, most likely to help cover-up the brutal way in which she and Katenies were arrested in the first place.

Meanwhile, Katenies was jailed after her brutal arrest, and was only able to have a bail hearing, at the Superior Court in Cornwall this past Monday (June 16, 2008).

Supporters from Six Nations, Sharbot Lake as well as Akwesasne attended court to be witnesses to Katenies' continued defiance of Canada's colonial courts. Several of the elders from the Akwesasne community referenced the bridge blockades undertaken in the 1960s and 70s to assert free movement of Indigenous peoples at the border. They consider Katenies' current stance as part of the same ongoing and long-term struggle for sovereignty.

At the hearing, the federal Crown lawyer objected to Katenies' release on bail. A senior investigator with the CBSA who seems to have launched a vendetta against Katenies since 2003, testified for the Crown. He outlined the various warrants and court dates in the case, and Katenies' continual and consistent refusal to recognize the authority of the colonial court system, or the jurisdiction of the CBSA over the border.

In the words of the CBSA investigator, Katenies "has nothing but contempt for the Canadian judicial system." The investigator, who has lived and worked at the Cornwall border crossing for two decades, was forced to admit that it's "not uncommon" for Mohawks to cite the lack of jurisdiction directly to border officials, although he called Katenies "an extreme case."

Both Katenies and her mother, Nancy Davis, addressed the court. Nancy Davis refused to tell the court whether she lived in the "Ontario" or "Quebec" part of Akwesasne, stating clearly that she "lives on Kanion'ke:haka territory" and is a citizen of the Haudenosaunee Confederacy. She remarked with a smile: "I'm the only one who has authority over my daughter."

Under cross-examination by the Crown lawyer, Nancy Davis stated: "We feel we have the right to travel where we want, to go where we want. [The border] is an imaginary line for Americans and Canadians, not Mohawks."

Asked outright if she recognized the authority of the court, Nancy Davis replied simply: "No."

Katenies also addressed the court, while reiterating from the start that she did not recognize its jurisdiction, and pointedly refused to accept all charges, declining to have them read to her. When the court clerk tried to swear her in, Katenies stated: "I can only tell what I know."

Katenies emphasized that she continues to demand that the courts address the jurisdiction question; that is, under what authority can colonial Canadian courts, agencies or officials claim to have jurisdiction over sovereign Mohawks. She stated forcefully: "I'm a passionate person, I'm a mother and I'm a grandmother. But, I've had no respect. No one has looked at what I've put forward."

Katenies already served the court with a Motion to Dismiss, and invoked the jurisdiction question, back on January 18, 2007, almost one-and-a-half years ago. Her complete motion is linked HERE.

Under cross-examination, Katenies was asked by the Crown lawyer if she would accept paying a cash bond; she replied: "That would be extortion at this point because jurisdiction has not been dealt with." She added: "I don't see why you should incarcerate me and beat me into submission without answering my question."

She threw the accusation of contempt back at the Crown, stating: “It is [your law] and your constitution that you keep talking about. Why do you continue to ignore me and our people, who have our own land and constitution?”

In his final submissions, the Crown argued that Katenies "has nothing but complete disdain for the laws of these courts." He also made the somewhat obvious point: "Quite frankly, your worship, both mother and daughter don't recognize our jurisdiction."

He asked the court to keep Katenies in custody, adding: "She's not interested in appearing in court and she doesn't recognize us."

Nonetheless, the presiding Justice-of-the-Peace, Ms. Leblanc, decided to release Katenies under some basic conditions: that Katenies reside with her mother and notify the Akwesasne police of any change of address (Katenies has lived with her mother for the past 8 years, since the passing of her father): that her mother post a surety (ie. a $1000 bond without any deposit); and that Katenies appear in court or designate counsel to appear in court for her. Her next court date was set for July 14, 2008 at 9am at Cornwall's Superior Court.

Both Kahentinehta and Katenies, despite the brutal attack on them by CBSA officials, maintain their defiance and vow to continue to challenge the jurisdiction of the courts and border officials.

IVAN APAOLAZA SANCHO, a Basque political prisoner who has been detained at Montreal’s Riviere-des-Prairies prison for almost one-year, facing removal to the Spanish state.

GURPREET SINGH, a freelance journalist based in Surrey, British Columbia, who provides a critical view of the recent apology offered by the federal and provincial BC government for the Komagata Maru incident of 1914, when migrants from India were refused entry to Canada.

Basque political prisoner in Montreal: Ivan Apaolaza Sancho

IVAN APAOLAZA SANCHO is a Basque political prisoner who, as of this coming June 20, will have been detained in Montreal’s Riviere-des-Prairies (RDP) prison for one year. He has lived in Canada for seven years, but has been declared ineligible for entry by the Canadian state, partially on the basis of evidence obtained by torture in Spain. In this exclusive interview, Ivan phoned No One Is Illegal Radio from his prison block at RDP, and shares his views about his detention, the evidence against him, his struggle for basic rights at RDP prison and more.

“Samosa politics”and apologies for the Komagata Maru incident of 1914

In 1914 a boatload of mainly Punjabi migrants from then-British India landed off the West Coast of Canada, and aimed to settle in BC as "British subjects". They were not even allowed to land on-shore, and with the use of the racist "Continuous Journey" provision, meant to restrict non-white migration to Canada, the migrants were forced to return to British-controlled India, where many were slaughtered in a one-sided skirmish with British imperial troops. In May 2008, 94 years later, the federal and provincial governments have offered formal apologies. For a critical view of the Komagata Maru apology, we speak with GURPREET SINGH who works with Radio India, and is a columnist for the South Asian Post and Surrey Now in British Columbia. Gurpreet criticizes the "samosa politics" of community gatekeepers, and asserts that the Komagata Maru incident of 1914 has very relevant lessons for migrant justice struggles today.

The International Migrants Alliance founding conference in Hong Kong

Later this month, the International Migrants Alliance (IMA) founding conference will take place in Hong Kong. The IMA comes together around the theme: "Migrants and refugees of the world: Unite to defend and fight for our rights! Struggle against imperialist attacks! Promote international solidarity!" We speak with RAMON BULTRON of the Asia-Pacific Mission for Migrants about the historic conference. Originally formed to fight for justice for Filipino migrants in the Asia-Pacific region, the Asia-Pacific Mission for Migrants now encompasses migrant workers -- both so-called illegal and legal -- from all over the Asia-Pacific region, including the Middle East. From Saudi Arabia to South Korea, from Hong Kong to Dubai, the Mission defends the interest of migrant workers from the Philippines, Indonesia, Nepal, Bangladesh, India, Pakistan, Sri Lanka and elsewhere.

MARYLYNN POUCACHICE: Marylynn is a member of the Lac Barriere Algonquin Community, located 5 hours north of Montreal, and a spokesperson for the Customary Chief and Council. The community has been resisting the imposition of Department of Indian Affairs-imposed chiefs, as well as the occupation of their community by the Surete de Quebec (SQ). In this interview, Marylynn describes the ousting of the Customary Chief and Council of her community in early March, during an SQ raid. She also speaks about the struggle to teach Algonquin in Lac Barriere schools, the blockades against logging in La Verendrye Park, the failure by governments to implement the trilateral agreements of 1991, and more.

ANGELA STERRITT: Angela is a grassroots organizer, artist and writer who belongs to the Gitxsan Nation of the Gitanmaax band in occupied “British Columbia”. She works with the Indigenous People's Free Skool, the International Indigenous Youth Network and Native 2010 Resistance. In this extended interview, Angela addresses the legacy of native elder Harriet Nahanee, the colonial origins of the Olympics, direct actions against natives who are collaborating with the organization of the 2010 Olympics, the appropriation of art and culture, the use of art and culture as resistance, the support campaign for John Graham, and the current activities of Native 2010 Resistance.
